Reflexiones sobre el error (C. 1097 § 2) y la violencia habitual

Abstract

En general, la violencia habitual tiene un acontecer imperceptible antes de hacerse evidente en la relación de pareja y, más específicamente, en el matrimonio. Por ello, este fenómeno exige analizar las distintas formas de violencia que sufre generalmente la mujer y la relación traumática que finalmente suele establecerse entre víctima y maltratador. Esta perspectiva obliga, al mismo tiempo, a una labor de interpretación de la normativa canónica y de los criterios empleados para la prueba en favor o en contra de la nulidad del matrimonio, que permita acoger la singularidad de los efectos que producen las agresiones en la víctima. La reflexión propuesta se limita al capítulo del error de cualidad (c. 1097, § 2), aunque puede ser aplicada a algunos aspectos del error doloso y de la condición.

Usually, before becoming evident, habitual violence has an imperceptible beginning in the couple relationship and, more specifically, in marriage. Therefore, this phenomenon requires analyzing the different forms of violence that women generally suffer and the traumatic relationship that is finally established between victim and abuser. At the same time, this perspective requires a work of interpretation of the canon law and the criteria used for the proof in favor or against the nullity of the marriage, which allows to accept the singularity of the effects that the aggressions produce in the victim. The proposed reflection is limited to the quality error ground (c. 1097, § 2), although it can be applied to some aspects of imposed error by deceit and condition.
