La condición potestativa en una reciente rotal (Sentencia Coram Pinto de 18 de junio de 2010: comentario, texto y traducción)

Abstract

El autor traduce y comenta la sentencia coram Pinto, afirmativa de la nulidad matrimonial por condición de futuro y con imposición de veto judicial para nuevas nupcias. En la primera parte se trata el supuesto de hecho, la causa canónica en el primer tribunal, en el segundo y en la Rota Romana. Finalmente comenta la jurisprudencia rotal sobre la exclusión de la indisolubilidad y la condición que se contiene en la sentencia traducida. La segunda parte contiene el texto latino de la sentencia y su traducción al español.

The author translates and discusses the sentence coram Pinto, affirming marriage nullity by future condition and with a judicial veto for remarriage. In the first part, the factual issue is discussed, the canonical case in the first tribunal, in the second and in the Roman Rota. Finally, it discusses the rotal jurisprudence on the exclusion of indissolubility and the condition contained in the sentence translated. The second part contains the Latin text of the sentence and its translation into Spanish.
