La prospettiva del difensore del vincolo nella fase istruttoria del processo

Abstract

Dopo aver presentato l’orientamento assiologico del difensore del vincolo nel contesto della visione istituzionale del processo canonico di nullità matrimoniale, il presente contributo esamina in primo luogo gli strumenti processuali a sua disposizione in fase istruttoria in relazione ai singoli mezzi di prova (in special modo alla perizia); in seguito illustra i tre nuclei di indagine trasversali rispetto al capo di nullità accusato: a) l’identità coniugale che ogni coniuge assume nel momento in cui manifesta il consenso; b) la relazione tra i coniugi da analizzare secondo un approccio sistemico-relazionale; c) la qualità dell’amore tra i coniugi. Lo studio si basa inoltre sul presupposto che il corretto comportamento del difensore del vincolo – a cui compete indagare, proporre e chiarire ciò che adduce alla nullità del matrimonio – implica la necessità di cooperare attivamente alla ricerca della verità durante la fase istruttoria.

After clarifying the axiological orientation of the defender of the bond in the context of the institutional vision of the canonical process of matrimonial nullity, the paper examines first the concrete procedural instruments at its disposal during the investigation stage in relation to the various means of proof (with an emphasis on Court Expert report), then it focuses on three specific groups of investigation crossing the ground of nullity agreed in a particular case: a) the identity of every marital spouses is called to take at the time of consent; b) the relationship between the spouses to deepen in a relational-systemic perspective; c) the nature and quality of the love between the spouses. The contribution is based on the assumption that the right action of the defender of the bond - who shall investigate, propose and clarify everything that is opposed to the nullity of the marriage – requires in the instruction phase an active cooperation in ascertaining the truth.
