Abstract

El artículo tiene como objeto llevar a cabo un amplio análisis en torno a la problemática originada por los denominados “delitos de odio”, centrándose en la figura del hate speech o discurso de odio, y las implicaciones que este puede tener en la relación entre dos derechos fundamentales, a saber, el derecho a la Libertad de expresión y el derecho de Libertad religiosa. A lo largo del texto se exponen los amplios conceptos a los que se hace referencia, para así comprender mejor un conflicto más aparente que real, en el que el derecho no resulta ni la más idónea ni la única herramienta por implementar. La solución a la tensión suscitada no reside en una cuestión de límites sino en el respeto a la dignidad humana, siendo indispensable para ello un correcto entendimiento de ambos derechos fundamentales y de su fundamento.

The purpose of this article is to carry out an extensive analysis of the problematic caused by so-called “hate crimes”, focusing on the “hate speech” figure and the involvement that this can have in the relationship with two fundamental rights, namely, the right to freedom of expression and the right to religious freedom. The text discusses broad concepts in order to gain a better understanding of a conflict that is more apparent than real, in which the law turns out to not be the most appropriate but also not the only tool to be implemented. The solution to this raised tension does not lie in a question of limits, but in respect for human dignity and a correct understanding of both fundamental rights and their basis is essential for this.
