El código de 1917 en la historia del derecho de la Iglesia

Abstract

El artículo desarrolla un breve y contrastado acercamiento históricoeclesiológico a un evento decisivo en la historia del derecho canónico: el nacimiento del Código de 1917. En primer lugar, se presenta la inaplazable necesidad que tenía la Iglesia de abordar la reforma de su legislación propia. Seguidamente, se presenta la eminente figura del Papa Pío X, como el principal promotor de la reforma; a continuación, se explican las finalidades propias de este esfuerzo codificador como respuesta a unas determinadas exigencias históricas y las diversas novedades implementadas. Por último, si bien no restan importancia a la aparición del Código de 1917, se señalan los posibles defectos y desventajas que la propia codificación píobenedictina podía ocasionar.

The article presents a brief critical historical-ecclesiastical introduction to a decisive event in the history of Canon Law: the origin of the Code of 1917. Firstly, it presents the pressing need of the Church to tackle reform of its own legislation. Next, it presents the eminent character of Pope Pius X as the main sponsor of the reform. Then the aims of this codification effort are explained as a response to certain historical demands together with the various new provisions. Finally, although they do not detract importance from the appearance of the Code of 1917, some potential defects and disadvantages that the codification of Pius-Benedict might have caused are indicated.
