Las técnicas de reproducción asistida en la jurisprudencia y en el cine de los Óscar

Abstract

El paso del tiempo y los grandes avances técnicos han dado lugar a que se puedan tener hijos no solo de forma biológica o por adopción sino también mediante otras técnicas o tratamientos médicos que facilitan el embarazo cuando éste no se consigue de forma natural. Actualmente, los principales tratamientos de fertilidad son la inseminación artificial y la fecundación in vitro (FIV). En este artículo se abordan las técnicas de reproducción asistida desde dos puntos de vista: el fílmico, analizando algunas películas que han sido nominadas a los Óscar en época reciente; y el jurídico, viendo la regulación legal y algunas de las sentencias más relevantes existentes hasta la fecha sobre este tema.

The passage of time and the great technical advances have led to the possibility of having children not only biologically or through adoption, but also through other techniques or medical treatments that facilitate pregnancy when this is not achieved naturally. Nowadays, the main fertility treatments are artificial insemination and in vitro fertilization (IVF). In this article the assisted reproduction techniques are approached from two points of view: the movie one, analyzing some films that have been nominated to the Oscars recently; and the legal one, seeing the legal regulation and some of the most relevant sentences existing to date on this subject.
